Cabin Rental Agreement Between Guest(s) and "A Rooster's Roost" property owners.

LIABILTY - Guest(s) agree to hold "A Rooster's Roost", its owners, and independent contractors harmless against any and all claims, suits, and causes of action for damage to personal property, injury, or loss of life sustained in, on, or around the rental cabin or property there of.


DAMAGE TO PROPERTY - Premises are to be left in clean, undamaged condition. Guest(s) assume full financial responsibility for damages to, or missing items from rental due to negligence or actions on their part. Within the first hour of occupying the cabin, if Guest(s) find any damaged furniture or items, please contact 239-822-6636 immediately. Guests are responsible for all damages to the cabins and their contents that may occur above normal wear and use.


LOST OR STOLEN ITEMS - Guest(s) agree that "A Rooster's Roost" owners will not be held responsible for any lost items, or any items stolen from, in or around the rental cabin.


SECURITY DEPOSIT - A $500.00 security deposit is required to hold your reservation. It will be refunded in full after your stay if there is no damage to the property or policy violation. By signing our consent form or staying in our cabin as a guest or the person reserving the cabin you agree that any charges for damages, missing items, fees for additional guests, not included on original invoice and/or additional cleaning fees in excess of the security deposit will be billed to the credit card you have provided to us and you have specifically provided the credit card for the purpose of providing payment on your credit card for damages or to be in compliance with this consent form. 


GARBAGE DISPOSAL - All garbage must be bagged in trash bags and placed in outdoor containers prior to departure. 


NUMBER OF GUEST(S) - Rental is limited to stated number in the agreement. An additional charge of $10/guest per night plus applicable taxes will be assessed for extra persons. Unreported extra guests will result in all guests immediately vacating the property without refund. 


NUMBER OF PET(S) - Rental is limited to the stated number of pet(s) in the party. A $50 fee will be charged for each pet with a $200 pet deposit refundable after checkout. Additional pets found to be on the premises will result in an additional assessment of $10/day. Cats are not permitted.


OWNER'S CLOSET - There is locked private Owner's Closets and outside shed that are not part of the Guest(s) rental and Guest(s) agree(s) not to disturb same


ACTS OF GOD - Owners are not responsible for Acts of God, fire, strikes, war, road maintenance, and inclement weather.  


REPAIRS & SERVICE CALLS - Owners can not guarantee against mechanical failures and Guest agrees to immediately notify Owners or their Agent(s) of defective or non-working units. Every effort to repair or replace defective units quickly and efficiently will be made. No refunds will be given for failure of mechanical units. Service calls resulting from neglect or misuse by Guest(s), or service calls found to be unnecessary & resulting in no repairs will be charged to the Guest(s) in the amount of the service call plus 10%. 


RIGHT OF ENTRY - Owners, or their Agent, reserves the right to enter property to investigate disturbances, check occupancy, check damages, and make repairs as deemed necessary.  Owners, or their Agent, will attempt to notify Guest(s) at least 2 hours in advance when service/repair entry is to take place.


GAS LOG FIREPLACE - No other item besides gas logs will be burned in gas log fireplace. It is unacceptable to use gas log fireplaces for the purpose of roasting marshmallows or preparing any food item. (Gas log fireplace use is seasonal and not available May through October). The gas supply will be turned off during this period.


HOT TUBS - Guest(s) will not bring or add any objects or chemicals to the hot tubs including but not limited to glass items, beer cans, wine bottles, suntan lotion, exotic creams, toys, soap, bubble bath, etc. (Hot tub use is seasonal and is not available November through April). Guest(s)understand that hot tubs can present a health risk if they are used more than 15 minutes at a time. They may also present a health risk for any use by women who are pregnant or think they may be pregnant, small children, or any person with a heart condition. The high temperature in a hot tub can cause injury to a fetus, collapsing of heart valves in small children, and a heart attack or stroke to anyone with a heart condition. I will not hold "A Rooster's Roost" owners  responsible for any property damage, injury, or loss of life resulting from use of a the cabin hot tub.


FURNISHING/FURNITURE - Any breakage, or damage, to furnishings/furniture in the cabin caused by Guest(s) are to be reported to the Owners immediately. Breakage or damage in excess of $10 will charged to the Guest(s). Please do not rearrange any furnishings.


LONG DISTANCE TELEPHONE CALLS  Only LOCAL Telephone calls are available from the cabin. Long distance calls should be placed using a calling card. 


UNRESTRICTED INTERNET ACCESS - The Internet can be accessed via a direct connect into the modem located down stairs next to the printer/FAX/scanner or via an UNSECURED wireless connection. Owners are not responsible for internet content.  


NON-SMOKING - We have a strict NO SMOKING policy. Failure to abide by this policy will result in forfeiture of your security deposit. No smoking is allowed inside the cabin or on the decks


HOLD HARMLESS - Guest(s) shall be solely responsible for any property damage, accident or injury to any person or loss sustained by any person arising out of or in any way related to Guest(s) use of the premises. Guest(s) understand that any outdoor exploration done on the property, which includes, but is not limited to, hiking on the property, or hiking paths across to the lakes, creeks or river, canoeing in the lakes, creeks or river, tubing in the lakes, creeks or river, fishing in the lakes, creeks or river, swimming in the lakes, creeks or river, or using the boat house etc. will all be done at Guest  and my Guest's own risk. Guest(s) will not hold "A Rooster's Roost" owners responsible for any accidents, injury, or loss of life resulting from the activities listed above, or any other unforeseen event.


CHILDPROOFING - Guest(s) understand that the rental cabin is not childproof and that extreme care must be exercised with children in and especially around the hot tub, electric outlets, decks and loft railings.


HOUSE PARTIES - EXCESSIVE SPEEDING – DISTRUPTIVE BEHAVIOR -  FIREARMS - FIREWORKS. - Occupancy and use of premises shall not disturb or offend neighbors or residents.  House parties, keg parties, excessive speeding, excessive noise and/or disruptive behavior, discharging of Firearms, BB or Pellet Guns, or Fireworks, etc. will result in guest vacating the property immediately without refund.


MOTOR HOMES ECT. - Campers or Motor Homes are not allowed to be hooked up to the rental property. If a hook up is discovered, occupancy will be terminated immediately without a refund, and deposit will be forfeited upon discovery.


ALCOHOLIC BEVERAGES/ILLEGAL DRUGS - Consumption of alcoholic beverages in rental units is limited to persons of legal age.  Illegal drug use is strictly prohibited and will result in termination of the contract, and dismissal of the guest without refund. 


BEAR - DEER - INSECTS. Bear, Deer, Turkey, Ladybugs, Carpenter Bees, Wasps, Scorpions, Ticks, Ants, Chiggers, etc. may be encountered in the mountains.  There is no refund for the presence of typical mountain creatures. There are black bears in the area. While not generally aggressive, they are dangerous wild animals and should never be approached or teased. Food should not be left outside, and garbage
containers should be closed and locked at all times.


LEASH LAWS - Guest(s) agrees to be in full control of their pets at all times and takes full responsibility for their pet's well being.  


KEY RETURN - Guest(s) are responsible for the return of the property keys. Guest(s) will be charged for re-keying or replacing of lock(s) if keys are not returned.


PET POLICY - Pets are not permitted in hot tub. Pets must be completely housebroken, well behaved, and pest free. Contamination of a home by fleas or other pet associated pests will result in  additional Guest(s) fees for professional pest removal. Guest(s) agrees to bring pet's crate, if pets are uncomfortable or stressed by a new environment or being left alone. Pets must not in any manner mar or alter the condition of the home.  Guest(s) are responsible for cleaning up after their pets and disposal of same.


VIOLATION OF AGREEMENT/CONTRACT - Owners or their Agent(s) reserves the right to remove renter without refund if any of the above agreed upon items are not met. Renter agrees that the security deposit authorization may be used for charges described above when in violation of the rental contract, and/or the credit card used at check-in/registration and that their signature on this contract authorizes same.  Failing authorization, the card used for the rental deposit shall be used, and their signature on this contract authorizes same. Guest understand that they will not receive a refund if they decide to depart the rental cabin early or shorten their stay or their guests don't show up once invoice is settled.


CANCELLATIONS - We will give a full refund for cancellation 30 or more days before the first rental day. Cancellation 14-29 days before the first rental day will forfeit the security deposit ,but the rent will be refunded. Cancellation 7-13 days before the first rental day will forfeit the rent. All cancellations must be provided in writing by fax, E-Mail, or certified mail. There are no refunds for shortened stays or if additional people invoiced lessen from the time of invoice or 14 days prior to reservation.


I have read and I understand the terms of this agreement. By signing below, I agree on behalf of myself and my rental party to these terms. I further agree to inform the other members of my rental party of the terms and insure that they abide by them as I am responsible. Guest(s) agree to follow the Check-Out Procedures list that are attached and made part of this agreement.

CHECKOUT PROCEDURES


Checkout time is 10:00 AM.


 


Please leave the key on the kitchen counter when you leave as the cleaning crew will be in shortly after you leave.


There is a lot of time involved in preparing the cabin for the next guest arrival, and any delay in your departure may result in the cabin not being ready for the next guests by 2:00 PM. We ask that you be courteous to other guests as we would ask them to do the same for you. These guests are excited and want to check into their cabin on time.


We do not expect you to clean the cabin before your departure, but we do ask that you leave it undamaged and as neat as you would leave your own.


  • Please place all dirty dishes in the dishwasher and start the dishwasher before your departure. (Dishes must be rinsed
    off before placing them in the dishwasher, and only dishwasher detergent - no dishwashing liquid- should be
    used in the dishwasher.)
  • Remove sheets and pillowcases from all beds that have been used and place them in the laundry area. Do not remove
    comforters, quilts, or mattress pads as these must be dry cleaned.
  • If you use a the sleeper sofa, please strip the bedding before folding it up and place the soiled sheets and pillowcases
    in the laundry area. (Please return the sleeper sofa to the normal sitting position)
  • Placed all soiled towels, washcloths, and kitchen linens (including all pot holders) that were used during your stay in
    the laundry area, (please do not leave wet linens on the wood floors)
  • Please return all games and /or puzzle pieces to their boxes and place in their designated spot(s).
  • Please return DVD's and VHS tapes to the area where they were originally found.
  • Please remove all food items from the freezer, refrigerator and cabinets (any items left behind must be thrown away).
  • Please make sure that all of your GARBAGE IS SECURED TIGHTLY IN GARBAGE BAGS AND PLACETHEM IN THE GARBAGE CANS PROVIDED OUTSIDE, AND PLEASE MAKE SURE THE LID IS
    SECURELY FASTENED. The garbage service will not pick up any loose trash left in the garbage cans. Failure to
    follow these instructions, including loose trash being placed in the cans, will result in an additional cleaning fee,
    which will be deducted from your Security Deposit.
  • If you used the grill during your stay, please make sure the grill and all utensils used are left clean. Also, please
    make sure that after each use the propane bottle for the gas grill is turned off and the cover is placed back on the grill. Grills that are not cleaned after use will result in an additional cleaning fee, which will be deducted from your Security Deposit.
  • If you use the hot tub, please make sure to replace and lock the cover down after each  use. Strong winds will blow  the cover off if not secured and may cause damage.                                                                    
  • Gas fireplace must be turned off upon departure from the cabin.
  • If you must move an object or piece of furniture, please return it to
    its designated spot before departing the cabin.
  • Please turn the thermostat to 55 degrees F in the winter months and 80 degrees F in the summer months.
  • Turn off all lights, ceiling fans, TV's etc
  • Please lock all doors and windows.
  • It is very probable that guests will be checking in to the same cabin on your departure day. To reduce any confusion,
    please make sure to remove all personal items before locking the door to the cabin. A retrieval fee of $10.00 plus cost
    of shipping will be charged for the return of items that are found; and will be returned only if requested by guest.
